Terms of Service

Welcome to Moya ("we", "us", "our"), a product of MY-LO (My Life Online), a South African company. These Terms of Service ("Terms") govern your access to and use of the Moya platform, including the website at mylo.co.za/Moya, the tender scanning engine, lead scoring, response drafting tools, and all related services (collectively, the "Service").
By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
- You must be 18 years or older and have the legal authority to bind your organisation to these Terms.
- The Service is available to South African businesses and to international businesses seeking South African tender opportunities.
2. Service Description
Moya is an agentic tender portal. We provide:
- Automated scanning of South African government, provincial, and private tender portals
- Lead scoring and relevance matching based on your business profile
- AI-assisted tender response drafting
- Deadline tracking, escalation, and submission pipeline management
- Win/loss analytics and reporting
The Service is a tool to assist your tendering process. We do not guarantee that you will win any tender. Tender decisions rest entirely with the issuing authority.
3. Account Registration
- You must provide accurate, complete, and current registration information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that provide inaccurate or misleading information.
4. Subscription Plans & Payment
4.1 Plans
We offer three subscription tiers: Starter, Professional, and Enterprise. Features and limits vary by plan as described on our pricing page.
4.2 Fees
- Subscription fees are billed monthly in South African Rand (ZAR) and are non-refundable except as required by law.
- We use PayFast (a third-party PCI-DSS compliant payment gateway) to process payments. We do not store your credit card or banking details on our servers.
- We may change our fees by providing at least 30 days' notice. Continued use after the change constitutes acceptance of the new fees.
4.3 Late Payment
If payment fails or is overdue, we may suspend your access to the Service until the outstanding amount is paid. We reserve the right to charge interest on overdue amounts at the maximum rate permitted under the National Credit Act.
5. Your Data & POPIA Compliance
- You retain ownership of all data you upload to the Service ("Your Data").
- By using the Service, you warrant that you have the right to upload Your Data and that it does not infringe any third-party rights.
- We process Your Data in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).
- You may request deletion of Your Data at any time by contacting us. We will comply within 30 days as required by POPIA.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Misrepresent your identity, qualifications, or business capabilities
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorised access to our systems or other users' data
- Scrape, harvest, or systematically extract data from the Service beyond what is provided through the normal user interface
- Resell, sublicense, or commercially exploit the Service without our written consent
7. Intellectual Property
- The Service — including all software, algorithms, designs, text, graphics, and underlying technology — is owned by MY-LO and protected by South African and international intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
- The tender content provided through the Service (tender notices, descriptions, documents) belongs to the respective tender issuing authorities. We provide it for informational purposes only.
8. Availability & Service Levels
- We aim to provide 99.5% uptime but do not guarantee uninterrupted access.
- We may perform scheduled maintenance with reasonable notice.
- We are not liable for interruptions caused by factors outside our reasonable control, including internet outages, force majeure events, or third-party service failures.
9. Limitation of Liability
- The Service is provided "as is" without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be error-free, that tenders will be accurately scored, or that you will win any tender.
- To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the fees you paid us in the 12 months preceding the claim.
- We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, business opportunities, or tender revenue.
10. Indemnification
You agree to indemnify and hold harmless MY-LO, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your breach of these Terms
- Your Data infringing any third-party rights
- Any tender submission made using the Service
11. Termination
- You may terminate your account at any time by contacting us or through your account settings.
- We may terminate or suspend your account if you breach these Terms, fail to pay, or use the Service in a way that harms other users or our systems.
- Upon termination, your right to use the Service ends immediately. You may export Your Data within 30 days, after which we may delete it.
12. Modifications
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after the changes take effect constitutes acceptance.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
14. Dispute Resolution
Before initiating legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If unresolved within 30 days, either party may refer the dispute to arbitration in Johannesburg under the rules of the Arbitration Foundation of Southern Africa (AFSA).
15. General Provisions
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
- Severability: If any provision is found invalid, the remaining provisions continue in effect.
- Waiver: Failure to enforce any right is not a waiver of that right.
- Assignment: You may not assign these Terms without our consent. We may assign them to a successor entity.
