MY-LO Referral Programme — Terms & Conditions
Effective 16 August 2026 · MY-LO (mylo.co.za), operated by the brand manager on behalf of the company. These terms govern the Refer & Earn programme.
Not legal advice. This is a plain-language summary of MY-LO's referral terms for SME introducers. It is not a substitute for advice from a qualified South African attorney. The executed referral engagement and these terms prevail; in case of conflict, the signed agreement governs.
Headline term: Commission is payable only on the one-off sale / setup fee (the installation package the referred client purchases). Commission is not payable on any recurring support, SLA, or monthly retainer — those are excluded by definition below.
1. Definitions
- "Referrer" — a person or entity registered in the MY-LO referral portal who introduces a prospective client.
- "Referred Client" — a business first introduced to MY-LO by the Referrer through the portal, and not already in MY-LO's records.
- "Qualifying Sale" — a confirmed, paid order by a Referred Client for a MY-LO setup/installation package (e.g. single-workflow or full-skill-set install).
- "Support/SLA Fee" — any recurring monthly support, maintenance, or service-level agreement (including the R3,000 and R8,000 tiers). Expressly excluded from commission.
2. Commission
- The Referrer earns a commission of 10% (ten percent) of the net value of a Qualifying Sale.
- Commission is calculated solely on the one-off setup/sale amount, exclusive of VAT, and exclusive of any Support/SLA Fee.
- Exclusion: No commission is due, directly or indirectly, on any recurring support, SLA, retainer, or renewal of the same client. The programme rewards customer acquisition, not ongoing service revenue.
- Example: a Referred Client buys the R15,000 full install + R8,000/month support. Commission = 10% of R15,000 = R1,500. The R8,000/month is excluded entirely.
3. Eligibility & Qualifying
- A referral must be registered in the portal before the client engages MY-LO commercially. Retrospective claims are not recognised.
- MY-LO marks the referral "won" only after the Qualifying Sale is paid in full. Commission accrues at that point.
- Where a client is introduced by more than one party, MY-LO's records determine the attributed Referrer at its reasonable discretion.
4. Payment
- Commission is paid within 14 days of the Qualifying Sale being paid in full, by EFT to the Referrer's nominated bank account.
- Commission is exclusive of tax. The Referrer is responsible for any tax, VAT, or statutory obligation arising from commission received.
- MY-LO may deduct any amount properly due where a Qualifying Sale is refunded or charged back.
5. Relationship, Conduct & Data
- The Referrer is an independent introducer. Nothing in this programme creates employment, partnership, agency, or fiduciary relationship.
- The Referrer processes personal information only as MY-LO's sub-processor, strictly for data the Referrer themselves submits via the portal. The Referrer must comply with POPIA and the ECT Act, and must have a lawful basis (e.g. consent) to share any prospect's data with MY-LO.
- Data scope: the Referrer has access only to referrals they submitted and their own portal data. The Referrer is not granted access to MY-LO's sourced leads, other referrers' leads, or any third-party personal information.
- Referrers must not misrepresent MY-LO's services, pricing, or the programme.
- The Referrer indemnifies MY-LO against any claim arising from the Referrer's handling, sharing, or processing of prospect data, or from any misrepresentation made to a prospect.
- MY-LO may suspend or terminate a Referrer's participation for breach of these terms or conduct prejudicial to MY-LO.
6. General
- MY-LO may amend these terms on notice published on this page; continued participation constitutes acceptance.
- These terms are governed by the laws of the Republic of South Africa.
